Estate Planning - Not Just For After Death

Estate planning is often thought of as planning for after death.  It that case, estate planning involves distribution of assets, providing for beneficiaries and otherwise passing along a legacy.  An equally important component of estate planning is providing for disability and incapacity, protecting assets from catastrophic medical costs and maintaining assets for the disabled individual and loved ones.  Absence of planning for disability can trigger "living probate" - the need for a conservatorship or guardianship, both very expensive, time-consuming and often intrusive legal procedures. Estate Tax Changes 1997-2013

A number of changes were made to the tax law for 2011 and 2012.  Many changes have to do with estate taxes - the federal death tax, gift tax and generation skipping transfer tax.  The article linked below explains those changes and also provides an excellent explanation of other changes, such as income and payroll tax changes.  One of the most interesting parts of the article is a chart listing changes in the estate tax every year from 1997 through 2013.  This illustration demonstrates how important it is to update and maintain your estate plan.

An estate plan that works will result in an orderly transfer of your assets with your wishes being carried out as you intended.  A recent article in a Massachusetts business journal entitled "Mistakes That Make a Litigator's Day" lists 11 mistakes that can land your estate in court for bitter and expensive battles.  For example, do-it-yourself document preparation, without thinking through ramifications and legal consequences, can result in ambiguities and unintended consequences that result in litigation.

Dealing With Digital Assets in An Estate Plan

An often overlooked aspect of 21st century estate planning is how to deal with digital assets - thinks like electronic accounts, passwords, blogs, websites, Facebook and the like.  There are some services avaiilable that can coordinate with your estate plan.  Sections can be built into a will or a separate memorandum to provide instructions to a digital executor or personal representative.  Often, people would choose a different person to act as personal representative or trustee for their digital assets than they would for their stocks, bonds, houses and cars.

Digital assets should be part of the discussion with your estate planning attorney.

Advance Directives, Healthcare Agents and a Good Death

Your advance directive is one of the most important parts of an estate plan.  The advance directive includes a health care power of attorney, a document giving a surrogate decision maker the power and authority to make health care decisions for you if you are unable to.  Also included is a living will, a document that expresses your withes for what types of life-sustaining measures you would like taken in the event you are terminally ill, in an irreversible coma or persistent vegetative state, and not expected to recover.

Choosing an agent under a health care power of attorney is not an easy decision.  Some family members may be too close to make a tough decision as you would make for yourself.  Whoever you choose, it is important to discuss your  wishes with them, preferably on more than one occasion.  Our firm often uses checklists and forms that help think through various scenarios that may arise and require difficult health care decisions.
