According to an excellent article by Judith Johnson in the Huffington Post, "The key to effective end-of-life planning is not to race through filling out legal documents, but rather to take our time to thoughtfully clarify our thoughts, attitudes, beliefs and feelings about dying and death first." Estate planning is often thought of as planning for after death. It that case, estate planning involves distribution of assets, providing for beneficiaries and otherwise passing along a legacy. An equally important component of estate planning is providing for disability and incapacity, protecting assets from catastrophic medical costs and maintaining assets for the disabled individual and loved ones. Absence of planning for disability can trigger "living probate" - the need for a conservatorship or guardianship, both very expensive, time-consuming and often intrusive legal procedures. A number of changes were made to the tax law for 2011 and 2012. Many changes have to do with estate taxes - the federal death tax, gift tax and generation skipping transfer tax. The article linked below explains those changes and also provides an excellent explanation of other changes, such as income and payroll tax changes. One of the most interesting parts of the article is a chart listing changes in the estate tax every year from 1997 through 2013. This illustration demonstrates how important it is to update and maintain your estate plan.

An often overlooked aspect of 21st century estate planning is how to deal with digital assets - thinks like electronic accounts, passwords, blogs, websites, Facebook and the like. There are some services avaiilable that can coordinate with your estate plan. Sections can be built into a will or a separate memorandum to provide instructions to a digital executor or personal representative. Often, people would choose a different person to act as personal representative or trustee for their digital assets than they would for their stocks, bonds, houses and cars.
Digital assets should be part of the discussion with your estate planning attorney.
